Until now there are discussions about the location of shamanism: some believe that it is practiced only in Siberia, Central Asia, and Northern Europe; others argue that it is spread almost over the whole world, particularly Asia, North and South America, Africa, and the Caucasus. In Europe, the first in formation about shamans appeared in the notes of travelers, diplomats, and researchers in the XVII century. During the XVIII-XIX centuries, the number of researches and literature about them was constantly growing. In the XX century, interest in shamanism did not disappear, but intensified. This paper will define the terms of the basic concepts that constitute the essence of a complex multifaceted phenomenon of shamanism. Etymology of the Term The term â€Å"shamanism† is widespread in many languages. According to one of the versions, the word â€Å"shaman† is derived from the Sanskrit  «Ã…›ramaá ¹â€¡a ». It means a wandering hermit or ascetic spiritual seeker, which primarily embodies traditions of ancient India. Along with Buddhism, the term has spread across Asia and penetrated Russian and Western languages. According to the other version, the word â€Å"shamanism† has a primordial Tungus-Manchurian origin. Every nation has its own names for shamans, which can vary even in one nation depending on the functions and categories of shaman. However, a man was called shaman in any society if he was a mediator chosen by spirits and had the ability to see the other reality and travel in it. Time of Occurrence of Shamanism The occurrence of shamanism cannot be determined accurately. The spirits of ancestors or spirits that inhabit the surrounding mountains, passes, forests, lakes, and rivers choose a particular person to be an intermediary between them and people. In cases when people have some difficulties or troubles (these can be illnesses, loss of property, death of a loved one, or any strange phenomena) or, on the contrary, when the spirits blame people (for example, for intrusion into the habitats of the spirits, or misperformance of sacrifice), the shaman acts as an intermediary, making people and imploring the spirits to do what is necessary. The French term â€Å"trance† is interpreted as stupefaction, detachment, and self-hypnosis. Another term â€Å"ecstasy† can be used to describe the condition in which the shaman acts. This Greek word means frenzy and enthusiasm, a special state that is inherent in poets and seers. Those who observe the behavior of the shaman during the ritual notice such things as convulsions, bulging eyes, froth at the mouth, fainting, and seizures. However, as a rule, during the trance the shaman does not lose connection with people who are present at the session. He often explains where he is currently located, and what he sees. The shaman uses self-hypnosis, concentrates his will, and mobilizes his mental and physical powers in order to achieve the state of trance. There is no doubt that a tambourine, from which the shaman extracts different sounds, plays an important role in the shamanic ritual. The shaman often sings to the beat. However, employee’s resignation may result in wrongful dismissal claim if the resignation is a result of the employer’s repudiatory breach of the contract. Under section 95(1)(c) of the Employment Rights Act 1996 the employee is entitled to resign, without giving notice, and can make a claim of wrongful dismissal for the losses he suffered as a result of the early termination of the contract. In order for a claim to succeed, the employee must show that the employer breached either an express or implied contractual term. Furthermore, the employee needs to show that his resignation is a response to the breach, and that such breach was adequately serious to justify the resignation. The employee will also need to show that he had not confirmed the contract following the breach by returning to work. When d etermining the seriousness of the breach, the courts and tribunals will consider the express and implied contractual terms that were breached. The implied duty of trust and confidence is considered an important duty owed to employees by their employers. This duty states that the employer owes duty of support in the event that an employee is subjected by other employees to any form of abuse. It requires an employer to investigate the complaint and to take appropriate action. This was considered in Bracebridge Engineering Ltd v Darby [1990] IRLR 3 where it was held that by failing to provide adequate support and follow appropriate grievance procedure, the employer had breached the implied duty of trust and confidence. In Western Excavating (ECC) Ltd v Sharp [1978] QB 761, the Court of Appeal attempted to define unreasonable conduct and found that the employer must act sensibly in the treatment of his employees. If the employer behaves or conducts his affairs so unreasonably that the e mployee cannot be expected to work in such environment any longer, the employee is justified in leaving. This definition of unreasonable conduct was criticised by Lord Denning, who stated that a certain degree of a particular behaviour may be considered to be in line with the employer’s business. The interpretation is nowadays very wide, however the principle set out in Western Excavating case remains a valid principle in establishing unreasonable conduct. To breach the term of trust and confidence, employer must have been acting in a way that is likely to destroy or seriously damage trust and confidence which must exist between the employer and employee. In Morrow v Safeway Stores plc [2002] IRLR 9, the employee was publicly reprimanded and generally had a bad working relationship with the manager of the store. The Employment Tribunal held that although the public reprimand was a breach of the implied term of trust and confidence, it was not serious enough to entitle the emp loyee to resign and claim unfair dismissal. The Employment Appeal Tribunal overturned this decision and emphasised that the breach of implied term of trust and confidence, if committed, is a fundamental breach stemming from the contract itself, and as such will entitle the employee to resign.

On the way to the hearing right outside the courtroom, the father of the black girl steps out and fires 3 shot which killed the 2 suspects. The father was arrested and put into jail. The town is split into two sides. One side understands Carl because a lot of fathers would have done same thing in his situation, but on the othere side that contained most of the town people want him to be punished in the gas chamber. Jake Brigance, a young and idealistic, inexperience white lawyer is hired by a murderer, of the two rapist, who raped her daughter. Brigance an easy going liberal white lawyer in town, whose client always leaves without payment. Carl Lee Hailey, a black, charged of two counts of murder in the first degree, trapped in a judicial system that is greatly swayed by the racism of the world beyond. Jake Brigance as lead council, one of the few white southerners was given the impossible task proving that Mr. Hailey, innocent. Impossible, because of a mostly white county, and for a reason of win-at-all cost prosecutor, the racism and hypocrisy of the Mississippi citizens and judicial system. He intends to defend the accused with a plea of not guilty by insanity, trying to convince the jurors that Carl Lee had a momentary lapse in sanity after the rape incident. Jake Brigance becomes Hailey’s lawyer and realizes how complicated it is to deal with such a famous client. Jake and his wife, Carla are at first excited at first about seeking Jake on the news so much during pre-trial happenings. The excitement quickly ends. He has to fight against the District Attorney who wants to use this sensational issue to make him become famous. The case got national attention and a lot of different organizations get involved. Situation starts a lot of commotion with in the community, people who are against Jake defending Carl try to disappoint and hurt him and his family. In the final argument in the court which Jake’s character also believe that anybody who’s on his position would do exactly what his dealing. He believes that justice taking its natural place on earth. Jake feels compelled to take the case out of his conscience and guiltiness over an action he may have been able to stop, the shooting of the two white suspects. Jake a defender of the downtrodden, and despite to defend his client by any means possible, the fact that he knows that Carl Lee’s actions were premeditated is troubling for his character’s integrity.
